Terms of Service

1. Agreement to Terms

By accessing or using Persona 3.0 ("the Service"), operated by Enginious Group S.A., KRS 0001007157, registered in Łódź, Poland ("Company", "we", "us"), you agree to be bound by these Terms of Service.

2. Description of Service

Persona 3.0 is a character engine platform that provides AI avatar generation, real-time conversation capabilities, voice cloning, and embeddable widget services across multiple subscription tiers.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Subscription Plans & Billing

• Free tier: unlimited avatar generation with watermark, no conversation minutes
• Paid tiers (Starter, Pro, Business, Enterprise): billed monthly via Stripe
• Conversation minutes are metered and reset monthly on your billing date
• Overage beyond included minutes is billed at the rate specified in your plan
• You may upgrade or downgrade at any time; changes are prorated
• Failed payments trigger a 14-day grace period before account downgrade

5. Acceptable Use

You agree not to:

• Generate avatars of real people without their explicit consent
• Clone voices of individuals without their explicit consent
• Use the Service for fraud, impersonation, or deceptive practices
• Use generated content for harassment, defamation, or illegal purposes
• Attempt to bypass watermarks, attribution, or usage limits
• Reverse-engineer the avatar generation or voice cloning models

6. Intellectual Property

You retain ownership of content you upload (photos, voice samples). Avatars generated from your content are licensed to you under your plan's terms. Free tier outputs include a non-removable watermark. Paid tier outputs grant commercial usage rights.

7. Content Moderation & Takedown

We reserve the right to remove any avatar or persona that violates these terms. Takedown requests for likeness violations will be processed within 24 hours. Repeated violations result in account termination.

8. Data Processing

Your data is processed in accordance with our Privacy Policy and Data Processing Agreement. All data is stored in EU-based infrastructure (Supabase EU, Cloudflare R2 EU).

9. Limitation of Liability

The Service is provided "as is". We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

10. Governing Law

These terms are governed by the laws of Poland. Disputes shall be resolved in the courts of Łódź, Poland, unless EU consumer protection regulations require otherwise.
